COMMON PROVISIONS. (a) It is presumed that the Bank shows required care and diligence in all acts and transactions. If the contrary is alleged, burden of proof belongs to the Customer. In case the Bank is kept responsible in any manner whatsoever, the Bank shall be responsible for the material and actual damage incurred only. The Bank cannot be held responsible for loss of profit or intangible damages. The Customer agrees that he shall not hold the Bank responsible for non-fulfillment, late fulfillment, cancellation or non-completion of operations because of any technical breakdown at electronic systems. (b) In case the Customer has more than one account, The Bank may transfer between the accounts at any time and in any manner he deems appropriate without receiving any instruction from the Customer. The Bank may amalgamate the accounts in one single account. When the branch, where the account is hold, has ceased its operations or as deemed necessarybythe Bank, the Bank may transfer the account to another branch at his choice. (c) The Customer declares and agrees that the books, microfilms, microfiches, audio records and computer records etc. of the Bank shall be valid, binding and conclusive evidence in any dispute arising from this Agreement; and in the event Bank’s books and records are kept based on the data processing records, the Customer agrees to waive any right to contest and defend, and the right to offer oath that the Bank records are duly kept in any court proceeding. If otherwise is pleaded, the burden of proof belongs to the pleading Account bearer. When the Bank is kept responsible, it is responsible only for actual material losses. COMMON PROVISIONS. (a) Payment services provided by the Bank are several services, including EFT and remittance using credit card, debt payment to credit card, depositing money in payment account, withdrawing money from payment account and all transactions regarding operation of the payment account, transfer of the fund in the payment account of the Client with the Bank, direct lending transactions, including those made only for one time, all money transfers including payment transactions performed by payment card or a similar instrument and regular payment order (remittance, EFT, SWIFT, fast money transfer, etc.), exclusion or acceptance of payment instrument, payment transaction, in which the consent of the Client regarding performance of payment transaction is given via internet banking, (b) Bu sözleşmenin (a) maddesinde sayılan ödeme işlemlerinin gerçekleştirilebilmesi için Müşteri, alıcı ad, soyad ve unvan bilgisi, T.C. kimlik numarası (TCKN), yabancı kimlik numarası (YKN), vergi kimlik numarası (VKN), hesap numarası (IBAN), müşteri numarası veya kullanıcı kodu, kredi kartı numarası, iletişim bilgisi (telefon, e-posta vb), alıcı banka adı, şubesi veya banka şube kodu, alıcı adres bilgileri, fatura ödemeleri için abone/tesisat numarası, vergi ödemelerinde vergi kimlik numarası (VKN), SGK ödemelerinde sicil numarası, işlem tutarı, para birimi, muhabir masrafının kime ait olacağı bilgisi ve işlemin mahiyetine göre yukarıdaki bilgiler arasından Banka tarafından talep edilen diğer bilgileri verir. (c) ▇▇▇▇▇▇▇ tarafından ödeme işleminin gerçekleştirilmesine ilişkin talimat Banka’ya ulaştığında veya uzaktan iletişim araçları aracılığı ile onay verildiğinde Banka yetkilendirilmiş sayılır. (d) ▇▇▇▇▇▇▇ tarafından Banka’nın yetkilendirilmesinden sonra işlem banka tarafından gerçekleştirilmediği müddetçe geri alınabilir. Ancak otomatik ödeme talimatları gibi doğrudan borçlandırma yöntemiyle yapılan ödeme işleminde, müşteri ödeme emrini en geç ilgili ödemenin vade gününden bir önceki iş günü sonuna kadar geri alabilir. (e) Müşteri Banka’ya ödeme emrine ilişkin yetkilendirmeyi işgünü saat 15.30’a kadar yapabilir. Bu saatten sonra yapılan yetkilendirme ertesi iş günü gerçekleştirilir. Ödeme emrinin belirli bir günde, belirli bir dönemin sonunda veya Müşteri’nin ödemeye ilişkin fonları banka tasarrufuna bıraktığı gündegerçekleştirilmesininkararlaştırılmasıhalinde, ödeme için kararlaştırılan gün ödeme emrinin alınma zamanı olarak kabul edilir.
