የቤኒሻንጉል ጉሙዝ ክልላዊ መንግስት የውሃ ስራዎች እና ኮንስትራክሽን ድርጅቶች እንደገና ለማቋቋም የወጣ አዋጅ

አዋጅ ቁጥር 149/2009 ዓ.ም

አዋጅ ቁጥር 149/2009 ዓ.ም የቤኒሻንጉል ጉሙዝ ክልላዊ መንግስት የውሃ ስራዎች እና ኮንስትራክሽን ድርጅቶች እንደገና ለማቋቋም የወጣ አዋጅ የክልሉን የመጠጥ ውሃ ሁኔታ ለማሻሻልና ለማስፋፋት እንዲቻል የቤኒሻንጉል ጉሙዝ ክልላዊ መንግስት የውሃ ስራዎች እና ኮንስትራክሽን ድርጅት ራሱን የቻለ መንግስታዊ ድርጅት ሆኖ በአዋጅ መቋቋም ያለበት በመሆኑ፤ የክልሉ የውሃ ስራዎች እና ኮንስትራክሽን ድርጅት እየገነባቸው ካሉ ከፍተኛ የውሃ ተቋማትና ህንፃ ስራዎች በተጨማሪ ከፍተኛ የመስኖ ግንባታዎች እንዲያካሂድ ስለተፈለገ እና እነዚህን ስራዎች ለመፈፀም የድርጅቱን አቅም ማጎልበት አስፈላጊ ሆኖ በመገኘቱ፣ በተሻሻለው የክልሉ ህገ-መንግስት አንቀጽ 49 ንዑስ ቁጥር 3.1 መሰረት የሚከተለው ታውጇል፡፡ ክፍል አንድ ጠቅላላ አንቀጽ 1 አጭር ርዕስ ይህ አዋጅ “የቤኒሻንጉል ጉሙዝ ክልላዊ መንግስት የውሃ ስራዎች እና ኮንስትራክሽ ድርጅት” እንደገና ለማቋቋም የወጣ አዋጅ ቁጥር 149/2009 ዓ.ም” ተብሎ ሊጠቀስ ይችላል፡፡ አንቀጽ 2 ትርጓሜ የቃሉ አገባብ ሌላ ትርጉም የሚያሰጠው ካልሆነ በስተቀር በዚህ አዋጅ ውስጥ፡- 1. “የክልሉ ም/ቤት” ማለት በተሻሻለው የክልሉ fhገ መንግስት አንቀጽ 46(1) መሠረት የተቋቋመው አካል ነው፤ 2. “የመስተዳድር ምክር ቤት” ማለት የክልሉ የህግ አስፈፃሚ አካል የሆነው የክልል መስተዳድር ምክር Proclamation No. 149/2017 Benishangul Gumuz National State Water Works and Construction Enterprise Reestablishment Proclamation WHEREAS, it is found necessary to establish Water Works and Construction Enterprise of Benishangul Gumuz National State as an autonomous governmental organization to improve and expand potable water supply of the region; WHEREAS, it also found necessary to develop the capacity of the enterprise so that the enterprise can undertake the construction of big irrigation schemes in addition to the large water institutions and building construction works; NOW, THEREFORE, the following is hereby proclaimed in pursuant to Article 49(3) of the Constitution of the regional government. PART ONE GENERAL Article 1 Short Title This proclamation may be cited as “▇▇▇▇▇▇▇▇▇▇▇ ▇▇▇▇▇ National State Water Works and Construction Enterprise Reestablishment Proclamation No. 149/2017”. Article 2 Definitions In this proclamation, unless the context requires otherwise, 1. “Regional Council” means the Council established in pursuant to the amended Constitution Article 46(1) of the region. 2. “Administrative Council” means the Regional Administrative Council which

ቤት ነው፤ 3. “ድርጅት” ማለት በዚህ አዋጅ መሰረት የተቋቋመ ውሃ ስራዎች ኮንስትራክሽን የመንግስት የልማት ድርጅት ነው፤ 4. “ተቆጣጣሪ ባለስልጣን” ማለት የመንግስት ባለቤትነት መብትን ለማስከበር ሲባል የክልሉ መስተዳድር ምክር ቤት ነው፤ 5. “ቦርድ” ማለት በዚህ አዋጅ አንቀጽ 6 ንዑስ ቁጥር 2 ስር የተቋቋመ የስራ አመራር ቦርድ ነው፡፡ 6. በወንድ ጾታ የተገለፀው አነጋገር ሴትንም ይጨምራል፡፡
ክፍል ሁለት መሰረታዊ ድንጋጌዎች አንቀጽ 3 እንደገና መቋቋም የቤኒሻንጉል ጉሙዝ ክልላዊ መንግስት የውሃ ስራዎች እና ኮንስትራክሽን ድርጅት ከዚህ በኋላ “ድርጅቱ” እየተባለ የሚጠራ የህግ ሰውነት ያለው የክልሉ መንግስት ልማት ድርጅት ሆኖ በዚህ አዋጅ እንደገና ተቋቁሟል፡፡
አንቀጽ 4 የድርጅቱ ዋና መስሪያ ቤት የድርጅቱ ዋና መስሪያ ቤት በአሶሳ ከተማ ሆኖ እንደአስፈላጊነቱ ቅርንጫፍ ጽህፈት ቤቶች ሊኖሩት ይችላሉ፡፡ አንቀጽ 5 የድርጅቱ ስልጣንና ተግባር ድርጅቱ የሚከተሉት ሥልጣንና ተግባራት ይኖሩታል፡- 1. የውሃ ሀብትን ለማልማት የሚሰሩ ስራዎች ላይ በመሰማራት የግድብ ስራዎችን፣ የመስኖ ስራዎችን፣ is the executive organ of the region. 3. “Enterprise” means a public developmental enterprise of Water Works Construction Enterprise that is established in accordance with this proclamation. 4. “Controlling Authority” means the regional administrative council which acts to protect the ownership right of the government. 5. “Board” means the management board that is established in pursuant to Article 6, Sub-article 2 of this Proclamation. 6. Expressions stated in masculine shall also refer to the feminine. PART TWO BASIC PROVISIONS Article 3 Reestablishment The Water Works and Construction Enterprise of Benishangul Gumuz National State, referred to as “the enterprise” hereafter, is hereby reestablished pursuant to this Proclamation, as a public developmental organization with a legal entity. Article 4 Head Office of the Enterprise The head office of the enterprise is located in Asosa town and branch offices may be opened as deemed necessary. Article 5 Power and Duties of the Enterprise The enterprise shall have the following power and duties: 1. Construction of dams, irrigation, hydropower plants, drinking water distribution lines, drinking water inspection works, construction of sewerage lines, drainage works,

የውሃ ሀይል ማመንጫ ግንባታዎችን፣ የመጠጥ ውሃ ማከፋፈያ መስመሮችን፣ የመጠጥ ውሃ ፍተሻ ስራዎችን፣ የቆሻሻ ማስወገጃ መስመሮችን፣ የድሬኔጅ ስራዎችን፣ ጥልቅና መለስተኛ ጥልቅ የውሃ ጉድጓድ ቁፋሮ ስራዎችን፣ ወንዝ መከላከል ግንባታ ስራዎችን፣ የመንገድና የህንፃ ግንባታዎችን ማከናወን፡፡ 2. የውሃ ሀብትን ለመስኖ እርሻና ተጓዳኝ ስራዎች ልማት ለማዋል የሚያስችሉ የመስኖ ፕሮጀክቶችን በኮንትራክተርነት ይሰራል፡፡ እንደአስፈላጊነቱ የገነባቸውን ፕሮጀክቶች የመስሪያ ዋጋቸውን እስኪመልሱ ድረስ ከተጠቃሚው ገንዘብ በማሰባሰብ ያስተዳድራል፡፡ የሚመለከተውን አካል በማስፈቀድ ለግንባታ ያወጣውን ወጪ ከተጠቃሚዎች በመሰብሰብ ገንዘቡን ለተመሳሳይ ልማት ያውላል፡፡ 3. ከከርሰ ምድር ውሃ ፍለጋና ልማት እንዲሁም ለውሃ ሀብት አስተዳደር የሚያገለግሉ መረጃዎችን ይተነትናል፡፡ 4. ለስራው የሚያስፈልጉ የግንባታ እቃዎች፣ ማንኛውም የኤሌክትሮ መካኒካል ስራዎችን፣ ቧንቧዎችን፣ ቫልቮችን፣ መገጣጠሚያዎችን፣ እንዲሁም ማናቸውም የውሃ ተቋም መሳሪያዎች፣ መለዋወጫዎችን የመግዛት፣ የማከማቸትና የመሸጥ መለወጥ ስራዎችን ያከናውናል፡፡ 5. የመጠጥ ውሃ፣ የመስኖ እና የህንፃ ግንባታን በተመለከተ ምህንድስናና ሌሎች የምክር አገልግሎቶች ይሰጣል፡፡ 6. የተወዳዳሪነት መርህ እንደተጠበቀ ሆኖ በልዩ ሁኔታ deep and medium water pits excavation works, construction of river wall protections, road and building constructions by engaging in water resource development activities; 2. It will carry out irrigation projects that enable the water resource to be used in agriculture, irrigation and other activities as a contractor. If deems necessary, it will manage its projects by generating funds from users until the projects refund their cost. When approved by concerned authoritative body, collects money from water users to reimburse the costs it incurred for construction work and reuses the money for similar development works. 3. Analyzing the data required for ground water exploration and water resources management activities. 4. Undertaking the activities of procuring, accumulating and selling construction materials, electro- mechanical goods, pipes, valves, fittings, spare parts and any other material used in water works. 5. Providing engineering and consultation services regarding potable water works, irrigation schemes, and building construction activities. 6. Without prejudice to the competitiveness principle, the enterprise shall give priority to and undertake development works which are provided by the government. The

ወሳኝ የሆኑ በመንግስት የሚሟሉ የልማት ጥያቄዎች ስራን ቅድሚያ ተሰጦት ይሰራል፣ ዝርዝሩም በደንብ ይወሰናል፡፡ 7. ከአለም አቀፍ ወይም አገር በቀል ከሆኑ ኮንትራክተሮች ጋር በጋራ መስራት፣ 8. ለረጅም ጊዜ ያለአገልግሎት የተቀመጡትን ንብረቶች በጨረታ የመሸጥ፣ ወደ ገንዘብ ሊቀየሩ የማይችሉ የሰነድ ሂሳቦችን እያጠና የመወሰን ተግባራትን ያከናውናል፡፡ 9. በአገሪቱ ውስጥ የውሃ ጥራት ትንተና ስራዎችን ያካሂዳል፡፡ 10.ለውሃና ተጓዳኝ የግንባታ ስራዎች የሚያገለግሉትን ማናቸውንም እቃዎችን መሳሪያዎችን ያመርታል፣ ከውጭ አገር ያስመጣል፣ ይሸጣል፣ ያከፋፍላል፣ ወደ ውጭ ሀገርም ይልካል፣ ያከራያል፡፡ 11.የንብረት ባለቤት ይሆናል፣ ውል ያዋውላል፣ ይከሳል ይከሰሳል፣ ቦንድ ያወጣል፣ በዋስትና ያስይዛል፣ ይሸጣል፣ በአክሲዮን ገበያ ይሳተፋል፣ 12.አላማውን ከግብ ለማድረስ የሚያስችሉ ሌሎች ተመሳሳይ ተግባሮችን ያከናውናል፡፡ አንቀጽ 6 የድርጅቱ አቋም ድርጅቱ፡- 1. ተቆጣጣሪ ባለስልጣን፣ 2. የስራ አመራር ቦርድ፣ 3. ዋና ስራ አስኪያጅ፣ 4. ምክትል ስራ አስኪያጅ፣ እና 5. ዋና እና ደጋፊ የስራ ሂደቶች እንዲሁም ለስራው አስፈላጊ የሆኑ ሰራተኞች ይኖሩታል፡፡ አንቀጽ 7 የተቆጣጣሪ ባለስልጣኑ ኃላፊነት details shall be determined by forthcoming regulation. 7. Working in cooperation with international and local contractors. 8. Undertaking the activities of selling properties that are not functional by issuing tenders, and reviewing and determining document accounts. 9. Undertaking water quality analyses in the country. 10. Manufacturing, importing, selling, distributing, exporting and renting materials required for water works and related activities. 11. It shall acquire assets, enter into contract agreements, can sue and be sued, issue bonds, provide securities, participates in share market. 12. Engaging in other activities which enable to realize its objectives.
Article 6 Organizational Structure of the Enterprise The enterprise shall have: 1. Supervising authority 2. Management board 3. General Manager 4. Deputy General Manager 5. Core and supporting processes as well as employees required to undertake the works. Article 7 Responsibilities of the Supervising Authority The Supervising Authority shall: 1. Ensure the rights of ownership of the

ተቆጣጣሪ ባለስልጣኑ፡- 1. ድርጅቱ የመንግስት የልማት ድርጅት እንደመሆኑ መጠን በድርጅቱ ላይ ያለውን የባለቤትነት መብት ማስከበር፣ 2. በዚህ አንቀጽ ንዑስ አንቀጽ 1 ላይ የተመለከተው አጠቃላይ አነጋገር እንደተጠበቀ ሆኖ ተቆጣጣሪው ባለስልጣን፡- ሀ) የቦርድ አባላትን ይመድባል፣ ያነሳል፣ ለ) ከሚመድባቸው የቦርድ አባላት መካከል የቦርዱን ሊቀመንበር ይሾማል፣ ሐ) ለቦርዱ አባላት ሊከፈል የሚገባውን አበል ይወስናል፣ መ) የድርጅቱን ካፒታል እንዲጨምር ወይም እንዲቀንስ ይወስናል፣ ሠ) የድርጅቱ የተፈቀደ ካፒታል በተወሰነ ጊዜ ውስጥ ተከፍሎ እንዲያልቅ የመጠባበቂያ ሂሳብ እንዲያዝ ወይም ከመንግስት ገንዘብ እንዲመደብ ያደርጋል፣ ረ) ከቦርዱ በሚቀርብለት ሀሳብ መሰረት ከድርጅቱ የተጣራ ትርፍ ውስጥ በየአመቱ ለመንግስት ፈሰስ ሊደረግ የሚገባውን መጠን ይወስናል፣ ሰ) በቦርዱ የሚቀርብለትን የድርጅቱን የኢንቨስትመንት እቅድ ያፀድቃል፣ ሸ) አስፈላጊ ሲሆን ድርጅቱ እንዲፈርስ፣ ከሌላ ድርጅት ጋር እንዲዋሃድ፣ እንዲከፋፈል ወይም እንዲሸጥ ይወስናል፡፡ ቀ) ለቦርድ የተሰጠው ስልጣንና ተግባር እንደተጠበቀ ሆኖ፣ የክልሉን መንግስት የባለቤትነት መብትን ለማስከበር የሚያስፈልጉ ሌሎች ተግባሮችን enterprise which is a public developmental organization. 2. Without prejudice to the general provisions of sub-article 1 above, the supervising authority shall: a) Appoint and dismiss members of the board; b) Appoint the chairperson of the board from among members of the board; c) Determine remunerations of members of the board; d) Make decisions on the increment or decrement of capital of the enterprise; e) Make sure that the allowed capital of the enterprise is paid within the set timeframe and that contingency fund is reserved or allocated from government finance. f) Determine, based on the recommendation of the board, the sum to be transferred to government accounts from the net annual profit of the enterprise. g) Determine on the dissolution, amalgamation, or dismantling of the enterprise, when deemed necessary. h) Without prejudice to the power and duties entrusted to the board, it shall also undertake other activities which are required to ensure the ownership rights of the regional government. Article 8

ያከናውናል፡፡ አንቀጽ 8 የስራ አመራር ቦርድ አወቃቀር 1. ድርጅቱ ተቆጣጣሪው ባለስልጣን በሚመድባቸው የስራ አመራር ቦርድ ይመራል፣ 2. የቦርድ አባላት ብዛታቸው 7 (ሰባት) ሆኖ ሰብሳቢና ፀሐፊ ይኖሩታል፣
አንቀጽ 9 የቦርዱ ስልጣንና ተግባር ቦርዱ ተጠሪነቱ ለተቆጣጣሪ ባለስልጣን ሆኖ የሚከተሉት ስልጣንና ተግባራት ይኖሩታል፡- 1. የድርጅቱን ዋናና ምክትል ስራ አስኪያጅ ለመስተዳድር ምክር ቤት አቅርቦ ይሾማል፣ ደመወዝና አበሉን ይወስናል፡፡ 2. ለድርጅቱ ዋና ስራ አስኪያጅ ተ ጠሪ የሆኑ ዋና ስራ ሂደት ሀላፊዎችን ቅጥር፣ ምደባ፣ ስንብት፣ ደሞዝና አበል የሚመለከቱ ጉዳዮች በዋና ስራ አስኪያጁ ሲቀርብለት ያፀድቃል፣ 3. የድርጅቱን የአጭርና የረጅም ጊዜ እቅድ እንዲሁም አመታዊ የስራ ፕሮግራምና በጀት ያፀድቃል፣ አፈፃፀማቸውንም ይከታተላል፣ 4. የድርጅቱ ሂሳቦችና ንብረቶች በአግባቡ መያዛቸውን ያረጋግጣል፣ የድርጅቱን የሂሳብ ሪፖርትና የውጪ ኦዲት ሪፖርት ያፀድቃል፣ ስለድርጅቱ የስራ አፈፃፀም ወቅታዊ ሪፖርትና የሂሳብ መግለጫዎች ለተቆጣጣሪ ባለስልጣን ያቀርባል፣ 5. የድርጅቱን የረጅም ጊዜ ብድሮችና ክሬዲቶችን ያፀድቃል፣ 6. በድርጅቱ ህልውና ላይ ወሳኝነት የሌላቸው ቋሚ Structure of the Board 1. The enterprise shall be managed by a management board established by the supervising authority. 2. The board shall have 7 (seven) members, including a chairperson and a secretary. Article 9 Power and Duties of the Board The Board shall be answerable to the Supervising Authority and shall have the following power and duties: 1. Selects candidates for General Manager and Deputy General Manager of the Board and presents to the Administrative Council for approval. 2. Approves employment, assignment, dismissal, remuneration and allowance of department heads answerable to the General Manager of the Enterprise and recommended by the General Manager. 3. Approves short and long term plans, work schedule and budget of the Enterprise and follows up performance of the same. 4. Ensures proper management of the Enterprise`s accounts and property; approves financial reports and external auditor`s reports; submits current performance reports and financial statements of the Enterprise to the Supervising Authority. 5. Approves long-term loans and credits of the Enterprise. 6. Approves sale of fixed assets which are not essential in the Enterprise`s

ንብረቶች ሽያጭ ያፀድቃል፣ 7. ድርጅቱ ትርፋማ ሆኖ ሲገኝ ለሰራተኛው የደሞዝና ጥቅማ ጥቅም ጭማሪ ያፀድቃል፡፡ ዝርዝሩም በደንብ ይወሰናል፡፡ 8. የድርጅቱ ካፒታል እንዲጨምር ወይም እንዲቀንስ ለተቆጣጣሪ ባለስልጣን ሀሳብ ያቀርባል፡፡
አንቀጽ 10 የቦርድ አባላት የስራ ዘመን የቦርዱ ሰብሳቢና የአባላቱ የስራ ዘመን 5 አመት ይሆናል፡፡ ሆኖም በድጋሚ የመመረጥ መብት የተጠበቀ ይሆናል፡፡ አንቀጽ 11 የቦርዱ ሰብሳቢ 1. ቦርዱ ቢያንስ በ3 (ሶስት) ወር አንድ ጊዜ ይሰበሰባል፣ ሆኖም አስቸኳይ ሁኔታ ሲያጋጥም ወይም ከቦርዱ አባላት መካከል ቢያንስ 5(አምስት) አባላት ሲጠይቁ ሰብሳቢው አስቸኳይ ስብሰባ ሊጠራ ይችላል፡፡ 2. ከቦርዱ አባላት ከግማሽ በላይ የሚሆኑት በስብሰባው ላይ ከተገኙ ምልዓተ ጉባኤ ይሆናል፣ 3. ቦርዱ ውሳኔ የሚያሳልፈው በስብሰባው በተገኙ አባላት ድምፅ ብልጫ ይሆናል፣ ሆኖም ድምጽ እኩል የተከፈለ እንደሆነ ሰብሳቢው ያለበት ወገን ሀሳብ የቦርዱ ውሳኔ ሆኖ ይፀድቃል፣
አንቀጽ 12 የዋናው ስራ አስኪያጅ ስልጣንና ተግባር existence. 7. Approves increase of remuneration and benefits of the employees when the Enterprise becomes profitable. The details shall be determined by regulation. 8. Recommends on increase or decrease of the Enterprise`s capital to the Supervising Authority. Article 10 Office Term of Members of the Board Office term of the Chairperson and members of the Board shall be 5 years. However, they are entitled for reappointment. Article 11 Meetings of the Board 1. The Board shall hold its meetings at least once every 3 (three) months. Nonetheless, the chairperson of the Board may summon for extraordinary meetings whenever there is an urgent issue or when this is requested by at least 5 (five) members of the Board. 2. Quorum is met when more than half of the members of the Board are present. 3. The Board shall made decisions through majority vote. However, in case of tie, the chairperson shall have a casting vote.
Article 12 Power and Duties of the General Manager 1. The General Manager of the enterprise shall be answerable to the

1. የድርጅቱ ዋና ስራ አስኪያጅ ተጠሪነቱ ለቦርድና ለተቆጣጣሪው ባለስልጣን ሆኖ የድርጅቱ ስራና አስተዳደር በሚገባ ለመከናወኑ የበላይ ሀላፊ ይሆናል፣ 2. ዋና ስራ አስኪያጁ በዚህ አዋጅ አንቀጽ 5 ስር የተመለከተው የድርጅቱ ስልጣንና ተግባር በስራ ላይ እንዲውል ያደርጋል፣ 3. በዚህ አንቀጽ ንዑስ አንቀጽ 2 የተመለከተው እንደተጠበቀ ሆኖ ስራ አስኪያጁ የሚከተሉትን ተግባራት ይፈፅማል፣ ሀ) የድርጅቱን ስራዎች ያደራጃል፣ ይመራል፣ ያስተዳድራል፣ ለ) ድርጅቱን ከሶስተኛ ወገኖች ጋር በሚያደርገው ግንኙነትና ድርጅቱ በሚያቀርባቸው ሆነ በሚቀርቡበት ክሶች ድርጅቱን ወክሎ ይሰራል፣ ሐ) በአሰሪና ሰራተኛ ጉዳይ አዋጅ ቁጥር 377/96 ዓ.ም መሰረት የድርጅቱን ሰራተኞች ይቀጥራል፣ ይመድባል፣ ያሰናብታል፣ መ) በድርጅቱ ስም የባንክ ሂሳብ ይከፍታል፣ ያንቀሳቅሳል፣ ፍቃድ ያወጣል፣ ያሳድሳል፣ ሠ) የድርጅቱን የስራ ፕሮግራምና በጀት አዘጋጅቶ ለቦርዱ ያቀርባል፣ ሲፈቀድም በስራ ላይ ያውላል፣ ረ) ለድርጅቱ በተፈቀደው የስራ ፕሮግራምና በጀት መሰረት የገንዘብ ወጪዎችን ይፈፅማል፣ ሂሳቡን በአግባቡ ይይዛል፣ በቦርድ ሲወሰን ሂሳቡን ያስመረምራል፣ ሰ) የድርጅቱን የስራ እንቅስቃሴና የፋይናንስ Board and the Supervising Authority and shall oversee the overall functioning of the enterprise. 2. The General Manager shall make sure that the power and duties of the enterprise stated under Article 5 herein are duly exercised and implemented. 3. Without prejudice to the provisions of sub-article2 of this Article, the General Manager shall have the following duties: a) Organizing, managing and administering the activities of the enterprise; b) Representing the enterprise in the dealings of the enterprise with third parties; c) Hiring, assigning and dismissing employees of the enterprise in accordance with Labor Proclamation No. 377/2003; d) Opening and running bank accounts in the name of the enterprise; getting licenses issued and renewed; e) Preparing and presenting activity plan of the enterprise to the Board; implementing the plan when approved; f) Effecting expenditures as per the approved work program of the enterprise; handling accounts appropriately; getting the accounts audited when decided by the Board; g) Preparing reports regularly on the operation and financial utilization of the enterprise; presenting the

አጠቃቀም በተመለከተ ወቅታዊ ሪፖርት ያዘጋጃል፣ ቦርዱ በሚወስነው ሁኔታም ለቦርዱ ያቀርባል፣ ሸ) በስራው ሂደት ላይ የሚመክርና በስራ ግምገማዎች፣ ዕቅዶችና ውሳኔዎች ላይ የሚወያይ የማኔጅመንት ኮሚቴ ያቋቁማል፣ ስብሰባውንም ይመራል፣ ቀ) አስፈላጊ ሆኖ በተገኘ መጠን ስልጣኑን ለድርጅቱ ስራ ኃላፊዎችና ሰራተኞች በውክልና ይሰጣል፣ በ) ለቦርዱ አስረጂ ይሆናል፣ ተ) ኦዲተሮችን ቀጥሮ የድርጅቱን የሂሳብ መዝገቦች ያስመረምራል፣ ቸ) በቦርዱ እና በተቆጣጣሪው ባለስልጣን የሚሰጡትን ሌሎች ተግባራት ያከናውናል፡፡ አንቀጽ 13 የምክትል ስራ አስኪያጅ ሥልጣንና ተግባር
1. የድርጅቱ ምክትል ስራ አስኪያጅ ዋና ስራ አስኪያጁ በማይኖርበት ጊዜ ተክቶ ይሰራል፣ 2. ሌሎች በዋና ስራ አስኪያጁና በስራ አመራር ቦርድ የሚሰጡትን ተግባራትም ያከናውናል፡፡
አንቀጽ 14 የገቢ ምንጭ ድርጅቱ የሚከተሉት የገቢ ምንጮች ይኖሩታል፡- 1. ከክልሉ መንግስት የሚሰጥ ድጎማ፣ 2. ድርጅቱ የሚያስከፍለው የግንባታ፣ የጉድጓድ ቁፋሮና ሌሎች የአገልግሎት ክፍያዎች፣ 3. ከማሽነሪና የሌሎች ንብረቶች ኪራይ የሚገኝ ገቢ፣ reports to the Board as determined by same; h) Establishing a management committee that deliberates on the operations, performance evaluation, plans and decisions of the enterprise; presiding over the meetings of the committee; i) Delegating his/her power to officials and employees of the enterprise whenever deemed necessary; j) Acting as consultant of the Board; k) Hiring auditors and getting accounts of the enterprise audited; l) Undertaking other activities assigned by the Board and the Supervising Authority.
Article 13 Power and Duties of Deputy General Manager 1. Acting as the General Manager of the enterprise in the absence of the General Manager. 2. Undertaking other activities as assigned by General Manager and the Management Board of the enterprise. Article 14 Sources of Income The enterprise shall have the following sources of income: 1. Subsidies granted by the regional government; 2. Service fees collected for the provision of construction, water hole digging, and other services. 3. Income collected from lease of machineries. 4. Revenues collected from other

ክፍል ሦስት ልዩ ልዩ ድንጋጌዎች አንቀጽ 15 የበጀት አመት የድርጅቱ የበጀት አመት በየአመቱ ከሀምሌ 1 ቀን ጀምሮ በተከታዩ አመት ሰኔ 30 ቀን ያበቃል፡፡ አንቀጽ 16 የሂሳብ መዝገቦች 1. ድርጅቱ የተሟላና ትክክለኛ የሂሳብ መዛግብት ይይዛል፣ 2. የድርጅቱ የሂሳብ መዛግብት ቢያንስ በዓመት አንድ ጊዜ በውጭ ኦዲተሮች ይመረመራል፡፡
አንቀጽ 17 ካፒታል የድርጅቱ የተፈቀደ ካፒታል በጥሬ ገንዘብ 4,259,891.75፣ በአይነት 63,758,669.19 በድምሩ 68,018,560.94 (ስልሳ ስምንት ሚሊዮን አስራ ስምንት ሺ አምስት መቶ ስልሳ ከዘጠና አራት ሳንቲም ነው፡፡ አንቀጽ 18 የተጠያቂነት ወሰን በማንኛውም ሁኔታ ድርጅቱ ካለው ጠቅላላ ንብረት በላይ በዕዳ ተጠያቂ አይሆንም፡፡ አንቀጽ 19 ድርጅቱ የሚቆይበት ጊዜ ድርጅቱ የሚቆየው ላልተወሰነ ጊዜ ነው፡፡ አንቀጽ 20 ደንብና መመሪያ የማውጣት ስልጣን sources. PART THREE MISCELLANEOUS PROVISIONS Article 15 Fiscal Year The Fiscal Year of the enterprise starts on Hamle 1 and completes on Sene 30 of the following year. Article 16 Account Registers 1. The enterprise shall keep accurate financial registers. 2. The financial registers of the enterprise shall be audited by external auditors at least once annually. Article 17 Capital The allowed capital of the enterprise is: in cash, 4,259,891.75; in kind: 63,758,669.19; totally, 68,018,560.94 (sixty eight million eighteen thousand five hundred sixty and 94/100). Article 18 Liability At any time, the liability of the enterprise shall not exceed the total assets of the enterprise. Article 19 Duration
The enterprise shall last for an unlimited period of time.
Article 20 Power to Issue Regulations and Directives

1. ተቆጣጣሪ ባለስልጣን ይህንን አዋጅ ለማስፈፀም አስፈላጊ የሆኑ ደንቦችን ሊያወጣ ይችላል፣ 2. የስራ አመራር ቦርድ ይህንን አዋጅ በሚገባ ለማስፈፀም አስፈላጊ የሆኑ መመሪያዎችን ሊያወጣ ይችላል፡፡ አንቀጽ 21 አዋጁን ስለማሻሻል ይህን አዋጅ የማሻሻል ወይም የመሻር ስልጣን የቤኒሻንጉል ጉሙዝ ክልላዊ መንግስት ምክር ቤት ብቻ ነው፡፡ አንቀጽ 22 የተሻሩ ህጎች
1. የቤኒሻንጉል ጉሙዝ ክልላዊ መንግስት የውሃ ስራዎች ኮንስትራክሽን ድርጅት ማቋቋሚያ ደንብ ቁጥር 18/1998 ዓ.ም በዚህ አዋጅ ተሽሯል፡፡ 2. ከዚህ አዋጅ ጋር የሚቃረን ማንኛውም አዋጅ፣ ደንብ፣ መመሪያ ወይም አሰራር በዚህ አዋጅ በተሸፈኑ ጉዳዮች ላይ ተፈፃሚነት አይኖረውም፡፡ አንቀጽ 23 አዋጁ ተፈፃሚ የሚሆንበት ጊዜ
ይህ አዋጅ በክልሉ ልሳነ-ህግ ጋዜጣ ታትሞ ከወጣበት ጊዜ ጀምሮ የፀና ይሆናል፡፡
አሶሳ 1. The Supervising Authority may issue regulations for the enforcement of this Proclamation. 2. The Management Board may issue directives for the enforcement of this Proclamation. Article 21 Amendment The power to amend or repeal this Proclamation shall solely be exercised by the Council of the Benishangul Gumuz National Regional Government.
Article 22 Repealed Laws
1. The Establishment Proclamation of Water Works and Construction Enterprise of Benishangul Gumuz National State is hereby repealed and replaced by this Proclamation. 2. Any proclamation, regulation, directive or procedure that is in contradiction with this proclamation shall not have applicability with regard to issues covered in this proclamation. Article 23 Effective Date This Proclamation shall become effective as of the date on which it is published on Lisane-Hig gazette of the regional state.
