Status. The Borrower is a sovereign state with power to sue and be sued and to exercise its rights and perform its obligations under this Agreement and the Project Documents and all action required to authorise its execution of this Agreement and the Project Documents to which it is party and its performance of its obligations thereunder has been duly taken.
