Pre. Umowa może być wypowiedziana przez Instytucję Zarządzającą bez zachowania okresu wypowiedzenia, w przypadku, gdy:
1) Projekt przestał spełniać kryteria, zawarte w Szczegółowym Opisie Osi Priorytetowych, Kryteriach Wyboru Projektów oraz zasadach kwalifikowalności wydatków określonych w wytycznych Ministerstwa Infrastruktury i Rozwoju, które zdecydowały o jego umieszczeniu na liście projektów stanowiących Załącznik Nr …………. do Uchwały Zarządu Województwa Świętokrzyskiego i został usunięty z tej listy;
2) Beneficjent nie przygotowuje Projektu na warunkach określonych w Pre-Umowie;
3) Beneficjent ukrył w trakcie tworzenia listy projektów informacje mogące mieć istotny wpływ na możliwość i termin przygotowania i/lub realizacji Projektu lub podał nieprawdziwe informacje o takim charakterze;
4) w toku przygotowania Projektu, po stronie Beneficjenta zaistniały obiektywne okoliczności uniemożliwiające przygotowanie lub realizację Projektu;
Pre. Umowa wchodzi w życie z dniem podpisania przez obie Strony.
Pre. Umowa nie stanowi umowy przedwstępnej w stosunku do umowy o dofinansowanie Projektu, o której mowa w ustawie.
