Common use of Applicability Clause in Contracts

Applicability. 16.1. The most recent version of these Terms and Conditions always applies to all Agreements between Emesa and the Supplier, unless the Parties agree otherwise. 16.2. Emesa shall be entitled to modify these Terms and Conditions, the Agreement or other rules that apply between Emesa and the Supplier, such as the Service Levels, at any time. Any such amendments shall take effect fifteen (15) days from the date the amendment is sent to the Supplier, or the date of its publication on the Platform. If the Supplier objects to the amendment in writing within these fifteen (15) days, the original Terms and Conditions shall continue to apply to them. The Supplier may also terminate the Agreement within this 15-day period. The Terms and Conditions can be consulted on the Platform at any time.
