Common use of Applicability Clause in Contracts

Applicability. 2.1 These Terms and Conditions apply to all Agreements between the Maker and DPG Media, including those that arise when the Maker, on their own initiative, offers a Contribution for publication, once or on a regular basis. If the Contribution is submitted on the Maker's own initiative, this will be explicitly recorded in writing. 2.2 The applicability of the Maker's general terms and conditions is expressly excluded. 2.3 Divergent stipulations, amendments and/or supplements to these Terms and Conditions are only valid if and insofar as DPG Media has expressly accepted them in writing and only apply to the specific Agreement for which they have been agreed. 2.4 With the applicability of these Terms and Conditions to the relationship between the Maker and DPG Media, any previously made arrangements, agreements and applicable general terms and conditions will lapse, with the exception of previously granted permission(s) from the Maker to publish or to be able to publish previously produced Contributions.
