Common use of Payment term Clause in Contracts

Payment term. Absent any special terms agreed with Cdiscount Advertising or contained in the GCMA, invoices must be paid within a maximum of forty-five (45) days end of month as from the invoice issue date; provided, however, that periodic invoices must be paid within forty- five (45) days of their issue date in accordance with article L.441-10 of the French Commercial Code. As an exception, if the Customer is also a supplier of Cdiscount, Cdiscount Advertising may apply a payment term identical to the payment term agreed for the payment of goods.The Customer owing payment acknowledges that payment of the price agreed in the Contract constitutes an essential condition.
