KAPPALE. LAIMINLYÖNNIT 9.1. Rahoitusosuuden maksun laiminlyön- ti. Jos sijoittaja (‘laiminlyövä sijoittaja’) ra- hastonhoitajan pyydettyä maksua jättää maksamatta rahoitusosuuden maksettavaksi erääntyneen erän (tai osan siitä) ja tämä laiminlyönti jatkuu 30 päivän ajan, rahas- tonhoitaja ilmoittaa laiminlyönnistä laimin- lyövälle sijoittajalle ja muille sijoittajille. Jos laiminlyövä sijoittaja ei 45 päivän ku- luttua ilmoituksesta ole maksanut eräänty- nyttä summaa täysimääräisesti, rahastonhoi- taja ilmoittaa asiasta muille sijoittajille. Sijoittajan, joka laiminlyö maksuvelvoit- teensa koealuerahastoa kohtaan, on korvat- tava rahastonhoitajalle ja koealuerahastolle kaikki maksun laiminlyömisestä aiheutuvat kulut tai vahingot.

KAPPALE. TOIMINNAN KESTO JA LOPETTAMINEN; TOIMINTAOHJEIDEN MUUTTAMINEN 12.1. Indemnification of Fund Manager and NEFCO. The Investors jointly and sev- erally agree to indemnify, defend and hold harmless the Fund Manager and NEFCO from and against all claims, liability, loss or expense (including costs and reasonable at- torney’s fees) in connection with the activi- ties of the TGF, relating to or resulting from the violation by any of the Investors of any law or administrative regulation or any ju- dicial, administrative or arbitration order, award, judgement, writ, injunction or de- cree. 12.2. Indemnification of Investors. The Fund Manager agrees to indemnify, defend and hold harmless the Investors from and against all claims, liability, loss or expense (including costs and reasonable attorney’s fees) in connection with the activities of the TGF, relating to or resulting from the viola- tion by the Fund Manager or NEFCO of any law or administrative regulation or any judicial, administrative or arbitration order, award, judgement, writ, in injunction or de- cree.
