Any conditions imposed as part of the Purchaser’s Zoning Application for Site and Architectural Plan for the Project and accepted by Purchaser.

If zoning is requested simultaneously with annexation, the petitioner must submit a completed Zoning Application form, provide a Zoning Map for the property, a zoning amendment map amending the official zoning map and pay the application and recording fees.
The Zoning Application will seek a rezoning of a limited portion of the Property consisting of 5+/- acres generally identified as “Phase 1” in Exhibit A to the PC District classification pursuant to the Sunbury Zoning Code.

Purchaser acknowledges that Seller shall have the right to modify the Zoning Application in Seller's sole and absolute discretion except that no modification which has a material adverse impact on the Property or Purchaser's intended use thereof shall be made without the prior consent of Purchaser.
