All notices and other communications hereunder shall be delivered to the address or email address set forth beneath the name of such party below (or to such other address or email address as such party shall have specified in a written notice given to the other parties): if to Stockholder: at the address or email address set forth on the signature page of this Agreement; and if to Parent: Zendesk, Inc.
Payments made by credit card, debit card or certain other payment instruments for the Zendesk Service are billed and processed by Zendesk’s Payment Agent.

Zendesk does not endorse, is not responsible or liable for, and makes no representations as to any aspect of such Non-Zendesk Services, including, without limitation, their content or the manner in which they handle, protect, manage or Process data (including Service Data), or any interaction between You and the provider of such Non-Zendesk Services.
Client may request Maintenance Services with respect to a problem with the Licensed Software by entering a ticket on Data Virtuality’s online support site or by placing an online ticket to Data Virtuality’s Technical Support Center through Zendesk 24 hours per day, seven days a week.
We are not responsible for notifying You, Agents or End-Users of any upgrades, fixes or enhancements to any such software or for any compromise of data, including Service Data, transmitted across computer networks or telecommunications facilities (including but not limited to the Internet) which are not owned, operated or controlled by Zendesk.
In such event, Zendesk is entitled to refuse processing of Personal Data that it believes to be in violation of any law or regulation.
