Yearly Quantity definition

Yearly Quantity shall have the meaning provided in Section 1.6(b).
Yearly Quantity means, for any calendar year, the annual quantity for the relevant Product to be purchased and sold hereunder during such year as specified in Annex A. The term "Cumulative Quarterly Quantity" means, for any one or more consecutive quarters in any calendar year, the Yearly Quantity for the relevant Product for such year, multiplied by the number of such quarters, and divided by four.

Examples of Yearly Quantity in a sentence

  • If the Seller – with the exception of a force majeure event – holds an amount of natural gas less than the Maximum Yearly Quantity determined in the Contract at the Buyer’s disposal, or if the Seller provides an amount of natural gas to the Buyer less than the amount indicated in the Buyer’s announcement of consumption demand, the Buyer shall be entitled to enforce a contractual penalty at a rate equivalent to 25 percent of the Gas Price against the Seller.

  • Subject to Article III, Section B, Article VII, Section A and Article IX below, during each Contract Year, Koch agrees to sell an▇ ▇▇liver to Buyer and Buyer agrees to take and pay for, or pay Koch the Con▇▇▇▇t Price if not taken, the Required Yearly Quantity of Product.

  • Buyer agrees to indemnify and hold harmless Koch and its ▇▇▇cessors and assigns from and against any and all excise taxes (but not including net income, excess profits, or corporate franchise taxes), inclusive of any penalty and interest, assessed at a future date against Koch by any government▇▇ ▇uthority upon the manufacture, use, sale, or delivery of the Required Yearly Quantity and/or Additional Volumes, whether taken or not.

  • If the Buyer fails to receive the contractual quantity, the Minimum Yearly Quantity or the minimum Contractual Monthly Quantity (if relevant) during the Delivery Period.

  • Subject to Article VII, Section B below, if during any Contract Year Buyer fails to take the Required Yearly Quantity (the difference between the Required Yearly Quantity and the quantity actually taken shall be referred to hereafter as the "Deficiency Volumes"), Buyer shall have the right to take delivery of the Deficiency Volumes during the twenty-four (24) months following the Contract Year it failed to take such Deficiency Volumes, including after the term of this Agreement expires.

  • In order to provide supply to the Buyer, the Seller books transmission and storage capacities, corresponding to the Maximum Contractual Yearly Quantity or the Maximum Contractual Monthly Quantity (if applicable in the given contract), at the cooperating natural gas system.

  • Subject to Article III, Section C, Article VII, Section A and Article X below, during each month of each Contract Year, ▇▇▇▇ agrees to sell and deliver to Buyer and Buyer agrees to take and pay for, or pay ▇▇▇▇ the Contract Price if not taken during the Month required to be taken, the Required Monthly Quantity of Product The total Required Yearly Quantity during the term of this agreement shall total 96,000 Tons.

  • Buyer's take of any Deficiency Volumes shall be in addition to its take obligations of the Required Yearly Quantity for the subject Contract Year.

  • If the Buyer takes off a heat quantity that exceeds the quantity set out in the Contract, the Maximum Yearly Quantity or the maximum Contracted Monthly Quantity (if relevant) due to any reason.

Related to Yearly Quantity

  • Daily Quantity means the quantity of waste discharged during an operating day.

  • Contract Quantity means the total number shares, contracts or other units of the Underlying Instrument that the Client is notionally buying or selling;

  • Type B quantity means a quantity of radioactive material greater than a Type A quantity.

  • Daily Contract Quantity or “DCQ” means the quantity of Gas as set out in Clause 4.1 herein.

  • Scheduled Quantity means the net quantity of Gas (being the difference between receipt and delivery nominations) agreed by MDL and the Welded Party to pass through (or, in the case of a Notional Welded Point, be deemed to have passed through) the relevant Welded Point for a Day.
