Examples of Xxxxxxxx Marks in a sentence

  • It is acknowledged and agreed that the name “Xxxxxxxx Xxxxxxxx Capital Management, L.P.” and any portion or derivative thereof, as well as any logo that is now or shall later become associated with the name (“Xxxxxxxx Xxxxxxxx Marks”), are valuable property of the Portfolio Manager and that the use of the Xxxxxxxx Xxxxxxxx Marks by the Trust or its agents is permitted only so long as this Agreement is in place.

  • Except as specifically provided herein, no license to the Xxxxxxxx Marks is hereby granted, and Purchaser is precluded from any use of the Xxxxxxxx Marks on any of its products or services as a means of corporate identity or in any of its communications.

  • Portfolio Manager consents to use of its name, performance data, biographical data and other pertinent data, and the Xxxxxxxx Marks (as defined below), by the Trust for use in marketing and sales literature, provided that any such marketing and sales literature shall not be used by the Trust without the prior written consent of Portfolio Manager, which consent shall not be unreasonably withheld.

  • Purchaser acknowledges and agrees with Sellers that as between Sellers and Purchaser, Sellers and their Affiliates have the absolute and exclusive proprietary right to all Xxxxxxxx Marks and other marks owned by Sellers or their Affiliates, and all rights to which, and that the goodwill represented thereby and pertaining thereto are being retained by Sellers and their Affiliates.

  • Subject to section 13.1, all rights, title and interest in Xxxxxxxx Technology, Xxxxxxxx Marks, and other Xxxxxxxx Intellectual Property are and shall remain solely with and the property of Xxxxxxxx.

  • Xxxxxxxx hereby grants to Buyer and its Affiliates a nonexclusive right and license to use the Xxxxxxxx Marks in accordance with this section 13.1.

  • Subject to the conditions and restrictions set forth herein, Xxxxxxxx hereby grants to Radtec a nontransferable, nonexclusive and limited right and license to reproduce, copy and publicly display the Xxxxxxxx Marks on the splash screen and windows of the Software Products.
