  • Nothing contained herein shall constitute XOX the agent of the Company, and XOX shall have no authority to bind, or act in the name of or on behalf of, the Company.

  • In the event that XOX determines that it does not wish to seek patent protection for a particular invention relating, to the Conveyed Rights, the Company shall be free to apply for a patent solely in its own name with respect to such invention, at its sole cost and expense, and be the sole owner thereof, provided, however, that XOX shall have a non-exclusive world-wide right and license, with right to sublicense, under any such patent application or patent issuing thereon.

  • XOX shall qualify and check for compatibility with a demonstration unit all future releases of the Software.

  • The Company may effect such conversion by sending written notice of such conversion to XOX; and notice shall be effective for all maintenance obligations arising 30 days after the date such notice is sent to XOX by the Company.

  • Except as provided in this Agreement, XOX MAKES AND THE COMPANY RECEIVES NO WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE; AND XOX SPECIFICALLY DISCLAIMS ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR WARRANTY CONCERNING THE QUALITY OR PERFORMANCE OF THE SOFTWARE, DEVELOPMENT ENVIRONMENT OR DOCUMENTATION.
