Examples of XL Information in a sentence

  • In the event that a Secured Party or a Secured Party Representative is required by applicable law, regulation or by legal process, to disclose any of the XL Information, the applicable Secured Party agrees that it will provide the Borrower with prompt written notice of such request(s) and when possible prior to the required disclosure such Secured Party shall use reasonable efforts, at the Borrower’s expense to seek a protective order or other appropriate remedy.

  • Notwithstanding the foregoing, the XL Information may be disclosed by any Secured Party to permitted assignees and participants and potential assignees and participants in the Facility to the extent such disclosure is made pursuant to a written agreement of confidentiality substantially similar to this Section 9.09(c).
