A reference to any guidance or policy is a reference to it as amended, superseded, or replaced from time to time. A reference to a statute or statutory provision is a reference to it as amended, extended or reenacted from time to time. A reference to a statute or statutory provision shall include all subordinate legislation made from time to time under that statute or statutory provision. Unless the context otherwise requires, any reference to European Union law that is directly applicable or directly effective in the UK at any time is a reference to it as it applies in England and Wales from time to time including as retained, amended, extended, re-enacted or otherwise given effect on or after 11pm on 31 January 2020. A reference to writing or written includes either letter or email only. Any obligation on a Party not to do something includes an obligation not to allow that thing to be done. Examples of WRES in a sentence

• Customer agrees to return all equipment furnished under this Agreement to WRES in the same condition as delivered, subject only to normal wear and tear.

• If Customer fails to make any payment or perform any obligation under this Agreement or becomes in any way the subject of a bankruptcy proceeding, WRES shall be under no obligation to furnish additional equipment or services to Customer until the default is cured and WRES may, without penalty, legal process or notice of any kind, immediately retake possession of all of its equipment from Customer, regardless of location.

• Notwithstanding any provision in WRES's limited liability company operating agreement to the contrary, REIT II is hereby admitted as the sole member of WRES.

• REIT II hereby agrees to cause WRES to indemnify, defend and hold harmless ▇▇▇▇▇ REF and ▇▇▇▇▇ Management and their successors and assigns, of and from any and all costs, liabilities and expense, including court costs and attorneys fees, arising from or connected with the operation of the Property Management Business by WRES or REIT II after the Assignment Effective Date.

• It is Customer’s sole responsibility to contact WRES to request all equipment relocations and final pick-ups.

• Termination of this Agreement shall in no way release Customer or guarantor from any sum, debt or other obligation, including any duty to defend and/or indemnify WRES, incurred or arising prior to such termination.

• REIT II has duly delivered the WRES Option Notice to ▇▇▇▇▇ REF, evidencing its desire to acquire and assume the Units.

• Customer will immediately notify WRES and discontinue use of equipment that is or becomes unsafe or dangerous, in any respect.

• Customer represents that it has authority to permit WRES to enter upon property upon which the WRES units are located to permit WRES to service, repair, or remove a unit and agrees to hold WRES harmless from WRES entry upon such real property for these purposes.
