Each final test result shall be rounded in one step to the number of places to the right of the decimal point indicated by the applicable WHDC emission standard plus one additional significant figure, in accordance with ASTM E 29-06.
It is because of the qualifications and identity of WHDC and the Borrower that the County Board is entering into this Agreement and that Transfers are permitted only as provided in this Agreement.

Annual Payments are due and payable to the County on this AHIF Note no later than June 1st of each year, beginning June 1st of the year following payments in an amount equal to the WHDC Deferred Developer Fee, but in no event beginning later than June 1, 2031, from the disbursement of Residual Receipts pursuant to the Loan Agreement.
As set forth in the AHIF Note, the Borrower shall repay the outstanding principal amount of the AHIF Loan of Eight Hundred Twelve Thousand and 00/100 Dollars ($812,000.00), plus accrued interest, in annual payments (“Annual Payments”) beginning June 1st of the year following payments in an amount equal to the WHDC Deferred Developer Fee by, or on behalf of, the Borrower, but in no event beginning later than June 1, 2031, from the disbursement of Residual Receipts pursuant to Section 2.05(b) below.
Subject to approval by the County Board, the Borrower may use the County’s twenty-five percent (25%) share of the Net Proceeds to either renovate the Property or assist WHDC in the purchase of the Property.
The County shall receive fifty percent (50%) of Excess Proceeds and the remaining fifty percent (50%) of Excess Proceeds shall be remitted to the Borrower, and the Borrower shall apply one hundred percent (100%) of the remitted Excess Proceeds toward the payment of the WHDC Deferred Developer Fee.
Borrower hereby covenants and agrees for itself, its successors and its assigns that, for the duration of the Term of the AHIF Loan, Borrower shall not commingle the funds or any other assets of Borrower related to the Property with those of WHDC, the Managing Member, the Investor Members, or any affiliates thereof.
