The Owner acknowledges that the Common User Wharves available for access by the Owner may change from time to time in Port of Melbourne’s complete discretion.
If there is a change to access arrangements or the status of the Common User Wharves listed in Schedule 3, Port of Melbourne will give notice of such change to the Owner or the Shipping Agent (as applicable).
The Shipping Agent must cooperate wherever possible with Port of Melbourne and other users of Port Facilities and the Common User Wharves, at least to the extent that such cooperation is necessary to ensure compliance with all Legislative Requirements, including the MTOFSA.
The Owner and the Shipping Agent must not make any alterations or additions to the Common User Wharves.
