  • The Project Partnerships intend that any buildings, structures, facilities, improvements, fixtures, ▇▇▇▇▇, sumps, ponds, machinery, tools, equipment or other real or personal property constructed, installed or placed upon the Right of Way Property (collectively, the "Additional Right of Way Assets") shall be paid for and owned jointly by the Project Partnerships and shall be deemed to be Jointly-Owned Assets (as defined below).

  • The Way Documents and Way Material Contracts are the only material documents and contracts currently in effect under and by virtue of which Way is entitled to Way Assets or which otherwise relates to or affects the interests of Way in Way Assets.

  • No other Persons own any Way Assets and there are no agreements or commitments to purchase or sell property or assets by Way.
