The Tribe shall adopt and implement a pretreatment program for the Jamestown System customers discharging High Strength Waste or Industrial Wastewater, with requirements at least as stringent as what the City Wastewater Source Control Program requires of City System customers.
A pattern or practice of violations by the Tribe, but not by non-Tribal connections to the Jamestown System, of the City Wastewater Source Control Program or DOE permit requirements for high strength waste or industrial wastewater, may be considered grounds for the City to terminate the Agreement, with ten (10) years advance written notice.
The City agrees to accept and treat High Strength Waste and Industrial Wastewater from the Jamestown System; however, the City shall have the right to regulate and control the conditions through the City’s Wastewater Source Control Program under which High Strength Waste and Industrial Wastewater is accepted into the City System.
The Tribe shall be responsible for any violations of the City Wastewater Source Control Program or DOE permit requirements resulting from Jamestown Flows but only to the extent such violations result in Wastewater originating from the Jamestown Service Area and not originating from City customers connected to the Jamestown System.
