Warranty Defects means material defects in the condition or quality of any Parts or Services supplied by LJC, which affect the safety, serviceability and/or airworthiness of the Aircraft, and which are subject to the warranty provisions in clause 15 below.

Examples of Warranty Defects in a sentence

  • For all other instances of Warranty Defects under the Performance Warranty, DB Contractor shall implement Warranty Action in accordance with the requirements and within the time periods specified in Item 32 of the Design-Build Specifications.

  • If the Parties cannot reach agreement on the terms of any such Work, within 14 days from the date of the inspection in which the requirement for such Work was identified, then such Work shall be deemed to have been excluded from this Agreement by the Parties and LJC shall proceed with the correction of such Warranty Defects it is responsible for in terms of clause 15.

  • All Remedial Work in respect of Warranty Defects shall be executed at the risk and cost of the Contractor.

  • Reseller shall use its commercially reasonable best efforts to determine whether problems with the Products are due to (i) user or operational error, (ii) a defect in the Product media, or (iii) a Product Error or other failure to meet the warranties set out in Section 11.1 (such Errors and failures are defined herein as "Warranty Defects").

  • If the Construction Contractor fails to provide such notice within such period, then the Construction Contractor shall be deemed to agree with the contents and requirements of such Warranty Defects List.

  • The Construction Contractor shall notify the Developer within seven Working Days of receipt of any Warranty Defects List whether it agrees with or disputes the contents of such Warranty Defects List and thereafter the Developer shall deliver such response to the Enterprises.
