In the event the Annual Transported Quantity for any Accounting Year of Operation Period exceeds the Annual Capacity, an additional payment (“Additional Logistics Charges”) shall be payable by the Authority Representative to be calculated as per the requirements of Schedule – H of this Agreement, subject to the Availability of the Specialized Wagons, as per terms and conditions of this Agreement.
In the event that the Service Provider fails to repair or rectify such defect or deficiency within a period of 15 (fifteen) days from the date of notice issued by the Authority in this behalf, the Authority shall be entitled to get the same repaired or rectified at the Service Provider’s risk and cost so as to make the Specialized Wagons conform to the Standards and Specifications, specifications of the RDSO and the terms and conditions of this Agreement.
The Service Provider shall at its own cost and expense, cure defaults if any, in the Specialised Wagons and the provisions of Article 23 shall apply, mutatis mutandis, in relation to curing of defects or deficiencies under this Article 22.
During the Procurement Period, the Service Provider shall, no later than 7 (seven) days from the end of each quarter, furnish to the Authority, a quarterly report on the progress of the procurement and supply of the Specialized Wagons/ ▇▇▇▇▇ and shall promptly give such other relevant information as may be required by the Authority in this regard.
The SCOD of the Additional Specialized Wagons shall be mutually discussed and agreed to between the Parties.
