  • In order for WilTel to perform its service obligations set forth in Sections 3.01 and 3.02, Vyvx agrees to make the Vyvx Property and, to the extent necessary, other Vyvx property directly connected (whether electrically, optically or otherwise) to the Vyvx Property, available to WilTel for inspection, measurements and evaluation at all reasonable times.

  • Vyvx further agrees to release WilTel, and any Affiliates, and hold WilTel and any Affiliates harmless from any claim, liability, judgment or costs which result from Vyvx's misuse, abuse, misapplication or improper use of the Vyvx Property.
