Examples of VST Consulting in a sentence

  • Unless you have purchased Polemarch Software Subscriptions from VST Consulting or an authorized reseller under the terms of a commercial agreement with VST Consulting, all use of the Polemarch Software shall be limited to testing purposes and not for production use (“Evaluation”).

  • VST Consulting does not warrant that the functions contained in the Polemarch Software will meet your requirements or that the operation of the Polemarch Software will be entirely error free, appear precisely as described in the accompanying documentation, or comply with regulatory requirements.

  • To the maximum extent permitted under applicable law, neither VST Consulting nor any VST Consulting authorized distributor will be liable to you for any incidental or consequential damages, including lost profits or lost savings arising out of the use or inability to use the Polemarch Software or any component, even if VST Consulting or the authorized distributor has been advised of the possibility of such damages.

  • Unless otherwise agreed by VST Consulting, you shall limit all Evaluation use to a single 30 day evaluation period and shall not download or otherwise obtain additional copies of the Polemarch Software or license keys for Evaluation.

  • VST Consulting reserves all rights to the Polemarch Software not expressly granted to you.

  • If the Polemarch Software contains Limiting Devices, VST Consulting will provide you materials necessary to use the Polemarch Software to the extent permitted.

  • VST Consulting warrants solely to you that the media on which the Polemarch Software may be furnished will be free from defects in materials and manufacture under normal use for a period of thirty (30) days from the date of delivery to you.

  • Unless otherwise agreed by VST Consulting, Evaluation of the Polemarch Software shall be limited to an evaluation environment and the Polemarch Software shall not be used to manage any systems or virtual machines on networks being used in the operation of your business or any other non-evaluation purpose.

  • In no event shall VST Consulting's liability or an authorized distributor’s liability exceed the amount that you paid to VST Consulting for the Polemarch Software during the twelve months preceding the first event giving rise to liability.

  • To the maximum extent permitted by applicable law, your exclusive remedy under this ▇▇▇▇ is to return any defective media within thirty (30) days of delivery along with a copy of your payment receipt and VST Consulting, at its option, will replace it or refund the money paid by you for the media.
