The problem is to calculate the estimated remaining Volume Credit on the Switch Date (VS).
In respect of any Look Back Measurement Period to which there is applicable a Carry Back Volume Credit, GE Capital shall pay to Danka a Trigger Payment Return in an amount equal to the lesser of (i) the Trigger Payment previously received by GE Capital from Danka in respect of such Look Back Measurement Period and (ii) the product of 4.75% multiplied by an amount equal to the Carry Back Volume Credit for such Look Back Measurement Period.
The excess of the Actual Volume in any Measurement Period over the Adjusted Target Volume for such Measurement Period shall first be applied as a Carry Back Volume Credit to any Volume Shortfall that occurred in the immediately preceding Measurement Period.
Customer shall be responsible for issuing purchase orders or amending previously-issued purchase orders to reflect the Recapture Amount or Volume Credit adjustments discussed in the preceding sentence.
For avoidance of doubt, the party owing the Recapture Amount or Volume Credit payable under this Agreement, as the case may be, shall immediately pay in full to the other party such amount upon the termination or expiration of this Agreement; provided, however, GEI may set off against any other monies owed by Customer to GEI.

If the HFRM Excess Volume Credit exceeds the amount of the Deficiency Payment for such Contract Quarter, such amount shall be credited against each subsequent Deficiency Payment hereunder, if any, until the HFRM Excess Volume Credit has been fully applied.
If, on any day after HWR has commissioned the Primary Delivery Point, HWR is, for any reason, unable or unwilling to accept (including for reasons of Force Majeure), EnCana’s Water at the Primary Delivery Point, up to the Firm Quantity, then, EnCana will receive a Volume Credit (hereafter defined) for the purpose of determining if EnCana has met its applicable Minimum Commitment in Section 5.
Each invoice shall include the amount of Water delivered at each Delivery Point, the Fee at each Delivery Point, the Minimum Commitment applicable during the current Contract Year, any Volume Credit applicable, and the total amount owed.
