  • Where Vism is required under this Agreement to give the Customer any notice in writing, Vism may give this notice by letter or by email.

  • In no event shall Vism, its employees, agents and sub-contractors be liable to the Customer to the extent that the alleged infringement is based on: (a) a modification of the Services by anyone other than Vism; or (b) the Customer’s use of the Services in a manner contrary to the instructions given to the Customer by Vism; or (c) the Customer’s use of the Services after notice of the alleged or actual infringement from Vism or any appropriate authority.

  • The Customer accepts all responsibility for and agrees to release Vism entirely from any claims, liabilities, disputes, actions or proceedings arising from or connected to the Customer’s interaction with any third party through, or as a result of the provision of Services or in respect to any transfer or transaction.
