Viral Open Source Software definition

Viral Open Source Software means software licensed under the GNU General Public License (GPL), GNU Affero General Public License (AGPL), GNU Lesser General Public License, or any other license that requires (as a condition of use, modification, or distribution) that software be: (A) disclosed or distributed in source code form; (B) licensed for the purpose of making derivative works; or (C) redistributed at no charge.
Viral Open Source Software means software that is or is intended to be subject to any Viral Open Source License.
Viral Open Source Software means any software which is not Permissive Open Source Software and which is licensed or has terms of use which would (i) subject any of GSK’s software or systems to a requirement (including a conditional requirement) that such software or systems be (a) made accessible or disclosed or distributed in source code form or (b) licensed for the purpose of making derivative works; or (ii) impose any restriction or control on the distribution, making accessible, disclosure or use of any GSK software or systems; or (iii) create, or purport to create, any obligation for GSK or its Affiliates with respect to any of GSK’s software or systems or any other software; or (iv) grant, or purport to grant, to any third party, any rights or immunities under any GSK Background IP or any GSK Work Product or GSK Arising IP allocated to GSK under this Agreement; or (v) impose any other material limitation, restriction, or condition on the ability of GSK or its Affiliates to exercise its rights under this Agreement.

  • You may not integrate, use, distribute, or otherwise combine the Developer Tools with any Viral Open Source Software.

  • No Intellectual Property Assets (1) contains, is derived from or is distributed with any Viral Open Source Software; or (2) otherwise imposes any material limitation, restriction, or the right or ability of Seller to use or distribute any Purchased Assets.

  • Nothing you develop under this Agreement will be considered for a commercial relationship for resale or distribution if it includes Viral Open Source Software.

  • Notwithstanding anything to the contrary in this Agreement, you are not licensed to (and you agree that you will not) integrate or use the SDK with any Viral Open Source Software (as defined below) or otherwise take any action that could require disclosure, distribution, or licensing of all or any part of the SDK in source code form, for the purpose of making derivative works, or at no charge.


More Definitions of Viral Open Source Software

Viral Open Source Software means any Open Source Software licensed under (i) any version of GNU GPL or LGPL or any Affero license or (ii) any other license which seeks to require any party which uses, modifies or distributes such code to make such code (or modification or derivative work thereof) or any other code which may be combined with or linked to such code available in source code form or which may impose any other obligation or restriction with respect to such party’s patent or other Intellectual Property Rights.

Viral Open Source Software means software that is or is intended to be subject to any Viral Open Source License. “Viral Open Source License” means any license for software that is “open source” or “copyleft” as those terms are commonly understood in the software industry, including, without limitation, any software license that: (i) requires licensees to disclose or otherwise make available the source code for any software incorporating, linking to or otherwise using the licensed software or developed using such licensed software; (ii) is a version of the GNU General Public License or the GNU Lesser General Public License; or (iii) is a license designated by the Free Software Foundation as “GPL- compatible” (a list of which is currently set forth at ▇▇▇▇://▇▇▇.▇▇▇.▇▇▇/licenses/license-list.html). Customer will promptly inform customer of any unauthorized use or disclosure of integrator keys provided as part of any API. CCH has the right to disable any Integration from interacting with any Legisway Service if CCH has a reasonable apprehension that any Integration may interfere with, degrade, or otherwise adversely affect any feature, functionality, or operation of the Legisway Service and or any related CCH system.
