This Stipulation may not be modified or amended, nor may any of its provisions be waived (except the conditions set forth in paragraph 2 of Article V, which may only be waived by Vaso and each Defendant), except by a writing signed by all Parties hereto or their successors-in-interest.

Any Person may seek to be excluded from the Class and the Settlement provided for by this Stipulation by submitting a written request for exclusion, which request must state the dates during the Class Period on which the Person purchased Vaso shares, the number and price of such shares so purchased or acquired, and the date, number and price of the sale of such shares so purchased or acquired.
