Variable Percentage definition

Variable Percentage means 65%.
Variable Percentage means (x) if no Event of Default has occurred or is continuing, 72.5% or (y) if an Event of Default has occurred and is continuing, 70%.
Variable Percentage means, for any date of determination, twenty-five percent (25%). For the avoidance of any doubt, the Conversion Rate shall only be amended for that certain Convertible Note Agreement between the Company and Investor dated April 23rd, 2014 and not that Convertible Note Agreement between the Company and Investor dated May 23rd, 2014.

More Definitions of Variable Percentage

Variable Percentage means, with respect to any Type of Accommodation under either Credit Facility for any particular day, the percentage per annum set out in SCHEDULE 3, which is applicable to such Type of Accommodation under such Credit Facility based on the highest level on the grid set forth in SCHEDULE 3 under the heading "Senior Debt Ratio" in respect of which the Senior Debt Ratio was met for the fiscal quarter immediately preceding the fiscal quarter during which such day occurs.
Variable Percentage means, for any date of determination, (x) if such date of determination is on or prior to the Lockup End Date, twenty-five percent (25%) or (y) if such date of determination is after the Lockup End Date, thirty percent (30%).
Variable Percentage means, for any date of determination, (A) if such date of determination is on or prior to December 19, 2014, twenty percent (20%) or (y) if such date of determination is after December 19, 2014, twenty-five percent (25%).
