Vacatur definition

Vacatur means modification or reversal of the award by a court in an appeals process that starts with the trial-level court. A winning claimant will petition the court to enforce the award by judgment, and the losing respondent may ask the same court to vacate the award.

Examples of Vacatur in a sentence

  • Not later than three business days after the earlier of (i) the entry by the District Court of the Vacatur requested in the Joint Stipulated Motion filed pursuant to Section 2.5; or (ii) sixty (60) days after the Effective Date, the Parties shall file a Stipulated Order of Dismissal, in the form of Exhibit A attached hereto, requesting the District Court to dismiss with prejudice the Litigation and all Claims asserted therein.

  • Not later than three business days after the Effective Date, MPG and ▇▇▇▇ ▇▇▇▇▇▇▇▇▇▇ shall file the Joint Stipulated Motion for Vacatur of the Court’s September 14, 2010 Memorandum and Order (Dkt #108), in the form attached as Exhibit B hereto.

  • Mesa shall have the right to exercise the foregoing extension only until the date that is thirty (30) days following the date US Airways makes a Vacatur Declaration.

  • Commencing on a date thirty (30) days after the occurrence of the Mesa Plan Conditions, if US Airways has not made a Vacatur Declaration, Mesa shall have the right to make a Vacatur Declaration.

  • Such cooperation shall mean executing documents and providing data and documentation concerning any En Masse Vacatur reasonably requested by Plaintiffs’ Counsel in Defendants’ possession, custody, or control pursuant to the terms set forth in paragraph 36 below.

  • In response to any motion, action or proceeding seeking an Individual Vacatur, Defendants shall send the LR Credit Judgment debtor a cover letter and stipulation of vacatur and discontinuance in the form attached as Exhibit A (with any edits provided by Plaintiffs’ Counsel to reflect changed contact information or as reasonably required to reflect the court, caption, attorney names or any other items to effectuate the vacatur and discontinuance without affecting any other rights of the parties).

  • Such cooperation shall also include Defendants communicating through their respective counsel with Plaintiffs’ counsel and/or relevant third parties (including the New York Attorney General and the Office of Court Administration) concerning questions Plaintiffs’ counsel or the relevant third parties may have regarding the data and/or documentation that Defendants produce concerning any En Masse Vacatur.

  • In the event US LEC has entered into a separate agreement for switching or services that include switching that are Vacated Elements but that are provided under this Agreement as of the date of the Vacatur Order, those switching Vacated Elements shall be transitioned pursuant to such separately negotiated agreement.

  • Beginning on the date of execution of this Agreement, Defendants shall promptly notify Plaintiffs’ counsel of any motion, action or proceeding seeking an Individual Vacatur and provide any known contact information of the individual seeking the Individual Vacatur.

  • Vacatur of the Supreme Court of Florida’s judgment is not appropriate because Petitioner caused the mootness by voluntarily settling the case.
