Utilization Report definition

Utilization Report is defined in Subparagraph 2(d)(iii).
Utilization Report means Catcher’s quarterly report identifying End Users, if any, to which Catcher sells Bundled Catcher Devices, the names of Catcher Distributor Partners to which Catcher has sold the Bundled Catcher Device, the and the fees due hereunder for any of the foregoing from the previous quarter. Catcher will require its Catcher Distributor Partners to submit to Innerwall the name of End Users to which they sell Bundled Catcher Devices if such Catcher Distributor Partners are permitted to do so.
Utilization Report means a report containing the names of all Resellers, the names of End Users using the Value Added Solution, the amount of use in the previous quarter, and the BEA License and Support Fees due, including the Net Revenue (as that term is defined in the Pricing Schedule) per transaction upon which License Fees are based, if the Pricing Schedule indicates that License Fees are based on a Percentage of Net Revenue. Such License and Support Fees will be reported and paid on a calendar quarterly basis within thirty (30) days after the end of the quarter. Utilization Reports should be sent to BEA Systems, Inc., Attention: Finance Department, 2315 North First Street, San Jose, California, 95131.

More Definitions of Utilization Report

Utilization Report means a report containing the names and number of End-Users using the Value-Added Solution and the amount of use in the previous quarter.
