To avoid doubt the aggregate value of Interim Capital Payments shall include payments made under Amendment No.1 in accordance with section 9(b) of Amendment No. 1 (quoted at Section 1.10 of this Contract) including payments for Utility Works made after the Commencement Date under the terms of Section 6 of Amendment No. 1 if HPTE has exercised the option to pay for Utility Works in this manner.
