All Utility Rent charges shall be due and payable monthly, together with the next payment of Base Rent (as defined below) that is not less than twenty-one (21) days following Landlord’s invoice for such charges.
Landlord may estimate the Utility Rent monthly, by meter readings, and invoice Tenant therefor, in arrears.
Tenant shall pay, as Additional Rent, in addition to and simultaneously with its payment of Base Rent, a monthly charge determined by Landlord, to cover the cost of all utility services, including, but not limited to, initial connection charges, all charges for electricity, water, sanitary and storm sewer service, and for all electric lights (the "Utility Rent").
Tenant’s right to object to Utility Rent shall be subject to the same audit rights in Section 4(h) below.
In such event, Tenant shall pay to Landlord within 30 days after billing, as additional rent, a sum ("Utility Rent") determined in the manner set forth below.
Utility Rent does not include charges for utilities consumed in connection with Common Area which are separately billed as an element of Operating Expenses as provided in Section 4(b) of this Lease.
It is the intent of Landlord to separately meter the Premises (either through existing submeters or through a Landlord installed meter (such as an E-monmeter) for electrical consumption, in which event Tenant shall pay for all charges for electricity consumption (including Excess HVAC and electricity for Supplemental Equipment) supplied to the Premises directly to Landlord as Utility Rent.
The amount of Utility Rent for Lease Year 1 shall be $42,000.00, payable $3,500.00 per month, and shall be adjusted by Landlord, semi-annually, based on usage by Tenant and rate adjustments.
The Engineer shall make a survey of Tenant's utility usage in the Demised Premises, to determine the Utility Rent.
The Annual Fixed Rent, Monthly Fixed Rent, Late Fee Rent, Additional Fixed Rent, Operating Expense Rent, Tax Rent, Insurance Rent, Additional Utility Rent, Security Deposit, and any other amounts payable by Tenant to Landlord under this Lease Agreement.
