Utility Failure definition

Utility Failure means any failure or shortage in the supply of natural gas, electricity or other utilities to the water and/or wastewater facilities provided that such failure or shortage is not caused or contributed to by the Contractor, its agents, contractors or subcontractors or those for whom the Contractor is legally responsible;

Examples of Utility Failure in a sentence

  • External Utility Failure No relief for External Utility Failure should be required where the SPV is required to provide back-up arrangements and so this definition may require amendment on a project by project basis.

  • If Landlord does not timely commence cure, and Landlord's Utility Failure continues for a period of thirty (30) consecutive business days following Tenant's notice, Tenant may terminate this Lease by delivering written notice of such termination to Landlord.

  • To the extent that an Availability Failure or a Performance Failure: is the result of an Excusing Cause; or [is the result of an External Utility Failure,] the Authority shall not be entitled to make Deductions.

  • If Landlord's Utility Failure continues for a period of three (3) consecutive business days following Tenant's notice to Landlord, then Tenant shall thereafter be entitled to an equitable abatement of Rent until such failure is cured.

Related to Utility Failure

  • Service Failure means a failure by the Contractor to provide the Services in accordance with any individual service level described above (measured on a monthly/quarterly/annual basis)

  • Supply Failure shall have the meaning ascribed to it in Section 2.8.

  • MI Failure means when an MI report: a) contains any material errors or material omissions or a missing mandatory field; or b) is submitted using an incorrect MI reporting Template; or c) is not submitted by the reporting date(including where a Nil Return should have been filed);

  • GEP Failure means Seller’s failure to produce Delivered Energy in an amount equal to or greater than the Guaranteed Energy Production amount for the applicable Performance Measurement Period.

  • Service Level Failure means a failure to perform the Software Support Services fully in compliance with the Support Service Level Requirements.
