Utility Documents definition

Utility Documents has the meaning set forth in § 4.9.3.
Utility Documents means any document evidencing the Borrower’s dedicated access to required infrastructure necessary to support the Project, including power, water and transportation infrastructure.

Examples of Utility Documents in a sentence

  • All Government Approvals and Host Utility Documents obtained pursuant to this Section 3.2.2 shall be obtained on behalf of and in the name of System Owner.

  • Section 5.14.2 Supplier shall take all actions, and do all things, necessary to obtain the Host Utility Documents, including those actions set forth on Exhibit P.

  • So long as Developer owns any Lot, Developer may create, amend and/or supplement the Governmental and Utility Documents as to the Lot(s) so owned by Developer without consent of any other Owner if the new document, amendment and/or supplement to the Governmental and Utility Documents impacts only Lots then owned by Developer and does not materially and adversely affect the Critical Access Drives or Common Maintenance Area, or the Shared Costs.

  • It is expressly agreed that so long as the Operator obtains the applicable consents (or deemed consents) set forth in this Declaration (and so long as this Declaration is not modified, amended, or terminated otherwise), the Operator has the authority to solely execute and create, modify or amend the Site Plan, this Declaration, and the Governmental and Utility Documents on behalf of the Owners, their successors and assigns, and Permittees in perpetuity.
