Useable Acres definition
Useable Acres means the gross acreage of a school site less any portion of the site publicly dedicated for off-site street improvements and any portion of the site not available for school purposes as determined by the CDE because of topological impediments or because of other unique circumstances.

Useable Acres means the gross number of acres of land contained within the boundaries of the Property, minus the number of acres of the Property that lie within (1) any encroachments; (2) the right-of-way lines of any roads, streets, alleys, railroads, or other rights-of-way; (3) the banks of any lakes, creeks, rivers, wetlands, or other water courses; and (4) the boundaries of any area determined to be flood-prone or subject to flood hazards under the Federal Flood Disaster Protection Act of 1973, as amended. To the extent that City agrees to accept title to the Property subject to any blanket easements or rights-of-way that are undefined with respect to their course and the area of the Property they cover, then City and Owner agree that such easements and rights-of-way will be deemed to be 30 feet in width for purposes of calculating the Useable Acres. Nothing contained in this section will be deemed to constitute a waiver by City of the right, under section 6, to review and approve all easements, rights-of-way, and other matters encumbering the Property. If the Final Plat (defined in section 5.2) indicates that the Property contains fewer than 20 Useable Acres, the Parties shall convene to modify or adjust lot lines, at Owner’s expense, so that the Property contains no less than 20 Useable Acres, to conform with the requirements of HB 3318.

Useable Acres means an area of land that is free and clear of encumbrances such as easements, utilities, and non-park related improvements, unless approved by the City in its sole discretion. Slope areas within the park boundaries greater than 4:1 (25%) are ineligible for park credit.
