Unknown Utilities definition

Unknown Utilities means existing Utilities, the location of which could not reasonably have been foreseen and which are either charted with unknown positions or uncharted;
Unknown Utilities means Utility Infrastructure discovered by Design Builder on or under the Lands following the Effective Date, which is not disclosed in or readily inferable from the Project Background Information;

Examples of Unknown Utilities in a sentence

  • Developer shall be entitled to seek compensation, Completion Deadline extension and performance relief under Sections 9.2.2, 9.2.3, 9.2.5 and 9.3 for the discovery of Unknown Utilities during Phase II Construction; provided that Developer shall not be entitled to any Claim for Delay Costs respecting discovery of Unknown Utilities.

  • Where the Concessionaire is required to relocate or divert Unknown Utilities, the Concessionaire shall be entitled, to such extension to the Time for Completion of the relevant Construction Works as the Independent Engineer considers to be appropriate in the circumstances.
