Nothing in this agreement contained shall be construed as a waiver of any party hereto of the right to assert any legal or constitutional right or defense as to the validity or invalidity of any law of the State wherein said Unitized Lands are located, or of the United States or the rules or regulations issued thereunder in any way affecting such party, or as a waiver by any such party of any right beyond his or its authority to waive.
In furtherance of this provision, a Market Partner shall not take any action that may reasonably be foreseen to result in drawing an inquiry from other Market Partners relating to the Market Partner’s other direct selling business activities.
Suspension of drilling or producing operations on all Unitized Lands pursuant to direction or consent of the Secretary, or his duly authorized representative, shall be deemed to constitute such suspension pursuant to such direction or consent as to each and every tract of Unitized Land; however, a suspension of drilling and/or producing operations on specified lands shall be applicable only to such lands.
Any Drilling Operations or Production Operations on or from the Pooled Lands or the Unitized Lands shall have the same effect as if the Drilling Operations or Production Operations, that are diligently and continuously pursued, were conducted on or from the Leased Lands.
Subject to the relinquishment provisions hereof, any lease committed hereto shall, as to the Unitized Lands, continue in force beyond the term so provided therein, or as extended by law, for the life of this Agreements; provided, actual sustained production is had under this Agreement or actual on site or off site construction of the initial facilities necessary for drilling and producing operations is commenced prior to the expiration of the term of such lease.
Nothing herein contained in this Unit Agreement shall be construed as a waiver by any party hereto of the right to assert any legal or constitutional right or defense as to the validity or invalidity of any law of the State where the Unitized Lands are located, or of the United States, or regulations issued thereunder in any way affecting such party, or as a waiver by any such party of any right beyond his or its authority to waive.
