Unit COD definition

Unit COD means, in respect of a Generating Unit, the date on which: (a) Substantial Completion for that Generating Unit has occurred in accordance with the provisions of the Power Plant Construction Contract, as certified by the Senior LendersTechnical Advisor; (b) the Unit Rated Capacity Test for that Generating Unit has been conducted in accordance with the ESC and which demonstrates that the Unit Rated Capacity of that Generating Unit is at least the Guaranteed Net Dependable Capacity for that Generating Unit; and (c) in respect of: (i) the First Generating Unit, either: (A) the Borrower has received: (1) three payments from PLN of the Electricity Charge by way of deposit into the relevant Project Account pursuant to the provisions of the Accounts Agreement;

Examples of Unit COD in a sentence

  • The amount received by the Procurer upon invocation of the Performance Bank Guarantee, in accordance with this Article 2.2(a), shall be treated as a cash-retention, and to the extent that there are no outstanding claims thereto, shall be released to the SPD, without any interest on such amount, upon the SPD achieving the Unit COD on or before the Unit SCOD, in accordance with Article 4.

  • The construction period for the Unit shall continue until the Unit COD is achieved (Construction Period).

  • The Procurer‟s obligation to pay to the SPD the Tariff Payments, in accordance with this Article, shall commence from the date on which RUMSL issues the Commissioning Certificate or the date of deemed issuance of the Commissioning Certificate as mentioned in the Confirmation Certificate or the SPD achieving the Unit COD, whichever is the earliest, in accordance with this Agreement.

  • Provided that in the event the Unit COD occurs post the Unit SCOD, then the Guaranteed Energy Offtake for the First Contract Year would be pro-rated to the remaining number of Months and/or Days, as the case may be.

  • Within 15 (fifteen) Days of receiving such notice, the SPD shall submit a written response to RUMSL and the Procurer setting out, in reasonable detail, the steps it proposes to take to expedite the construction of the Unit and time period within which it shall achieve the Unit COD.
