Unforeseen Underground Condition. An unusually severe condition related to the underground site conditions, which was not anticipated by the Contractor and would not have been reasonably foreseeable in a project such as the Project, encountered by the Contractor during the course of the prosecution of the Work, which is confirmed as such in writing by an independent technical consultant to be agreed upon by Owner and Contractor prior to the Notice to Proceed Date (or such other independent technical consultant mutually agreed to in writing by Owner and Contractor).
