Underlying offense definition
Underlying offense means the offense in respect to which the defendant failed to appear.
Underlying offense means the offense as to which the defendant is convicted of committing the misprision. Apply the base offense level plus any applicable specific offense characteristics that were known, or reasonably should have been known, by the defendant; see Application Note 129 of the Commentary to §1B1.3 (Relevant Conduct).
Underlying offense means an offense enumerated in subdivision (a) for which the defendant is being prosecuted.
