BCI expressly disclaims any and all liability and responsibility arising from your use of or reliance upon Underlying Data.
BCI does not warrant the accuracy, completeness, or usefulness of the Underlying Data.
Agent/Broker attests that the Data provides an accurate representation of provisions in actual insurance policies, EMR information or other underlying data (the actual underlying data, whether insurance policies, EMR information, or other supporting data, the “Underlying Data” for purposes hereof), and the Data does not supersede the terms and provisions of the Underlying Data.
In addition, for the avoidance of doubt, S&P is entitled to license the use of and/or distribute Underlying Data independently of this Agreement in any manner S&P desires, and S&P shall not be restricted from entering into any arrangement with its affiliates or any third party, including competitors of Licensee, in connection therewith.

In the event such 2D Underlying Data Product is unavailable, Licensor, in its sole discretion, will substitute the best 2D Underlying Data Product available, if any.
Advisor agrees and acknowledges that unauthorized copying of, use of, access to or distribution of the Marks, Patents, Stratified Indices, weights of the holdings of the Stratified Indices or the Underlying Data may cause Licensor, its affiliates, and/or their third-party licensors irreparable injury that cannot be adequately compensated for by means of monetary damages.
Licensee agrees and acknowledges that, in the event the Custom Indices and Underlying Data contain data from a third-party licensor and/or are made available on various Stock Exchanges, Commodity Exchanges, and other sources (collectively, the “Sources”), such third-party licensor and/or Sources may require Licensee to enter into separate agreements directly with the applicable third party and/or impose additional fees on Licensee either directly or through S&P.
