Unanticipated definition

Unanticipated thus means unaddressed by the contract. This factor is quite relevant to judging whether a threat is contrived because if any changed circumstances were already specifically addressed in the contract, then it seems unlikely that the change would have provoked a breach in a world where no modification were possible. For example, suppose costs have increased by 17%, but the contract specifically provides that if costs increase above 10%, the contract price will increase by the cost increase plus a specified markup. In that case, the parties have already determined what suffices to induce performance under those circumstances, so a claim that those circumstances would inevitably provoke breach seems contrived.
