TVOD definition

TVOD or “PPV” means the delivery and exhibition of a motion picture, television show or other entertainment product, where the timing of same is either (a) in the case of PPV, scheduled or pre-determined and not at the consumer’s discretion, or (b) in the case of VOD or TVOD, the timing of same is not scheduled or pre-determined but rather at the consumer’s discretion, in all cases, for which a transactional charge is assessed to the consumer for the privilege of viewing each separate exhibition of such motion picture, television show or other entertainment product (or multiple exhibition of such motion picture, television show or other entertainment product over a limited viewing period), in all cases which is not primarily advertising supported (and in any event, no advertising shall interrupt any content during the exhibition thereof). Each of VOD, TVOD and PPV does not include SVOD and shall not include delivery or exhibition for which the consumer is charged a “club” or other similar “access” fee (which fee shall not, for purposes of this definition, be deemed to include any basic cable, digital/data plan, equipment rental fee or Internet access fee) for the privilege of being able to view motion pictures, television shows or other entertainment products via VOD/TVOD/PPV unless such “club” or similar access fee is non-creditable against, and/or does not subsidize or otherwise affect the retail price for any per-exhibition consumer transaction fees and provided that in all events is a charge that is more than merely a fee to gain access to the VOD/TVOD/PPV programs alone. VOD/TVOD/PPV does not include programming offered on an FVOD/AVOD, SVOD, Subscription Pay TV, Basic TV or Free TV basis, and any per-transaction or per-view offering bundled with a SVOD or FVOD/AVOD proposition, and not part of a wider Subscription Pay TV service, for which the full a la carte per-transaction/per-view retail pricing of the program on such per-transaction/per-view offering is impacted by such bundle relative to the per-transaction/per-view retail price for such program on the same platform’s VOD/TVOD/PPV service that is not bundled with an SVOD or FVOD/AVOD proposition, would not qualify as VOD/TVOD/PPV hereunder.
TVOD means transactional video-on-demand; and
TVOD means VOD and EST.

  • Alternative for B14-productions (instead of the paragraph above): The Executive Producer undertakes to have a minimum of 36 months hold back for exploitation of the Production (e.g. through SVOD, TVOD, FVOD and broadcast) in the Co-producers’ territories, from the Executive Producer´s first publishing onwards.

More Definitions of TVOD

TVOD. (transactional video-on-demand) shall have the same meaning as SVOD except where the Subscriber is charged on a “per transaction” or “per exhibition” basis.
TVOD means the point-to-multi-point delivery of a single program (a) for which the viewer generally pays a per program transaction fee solely for the privilege of viewing each separate exhibition of such program, or series of exhibitions over a limited time period, which fee is unaffected in any way by the purchase of other programs, products or services on a pay-per- view basis
TVOD or “Transactional Video on Demand” means that mode of programming distribution by which Licensed Work/s is delivered by a programming service on an on-demand basis by means of streaming of the same via the internet or world wide web, that gives the Subscriber, upon payment of a transactional fee (a per-program or per-exhibition charge), the privilege of viewing the particular Licensed Work/s on a time-based (e.g., weekly, monthly) basis, where the start time for each such Licensed Work/s is chosen by the Subscriber and not scheduled by the Licensee, and where the Subscriber can view each such Licensed Work/s (usually with the ability to stop and start, pause, rewind or fast-forward a program) on a one-time basis for a period determined by the Licensee (e.g., a day).
TVOD means the delivery and exhibition of a motion picture, television show or other entertainment product, solely on a non-Ad Supported basis and non-subscription basis, where the timing of same is not pre-determined, but rather is at the consumer’s discretion, where the consumer is required to view the content over a limited period of time, and for which the consumer is charged a separate material transactional (i.e., per movie, and not bundled together or marketed as part of a “collection”) monetary fee (that is neither subsidized nor otherwise discounted by (i) the purchase of other products or services or (ii) promotions other than occasional, customary promotional offerings which are limited in scope and duration and which at no time offer the Titles for free) in exchange for the right to view each motion picture, television show or other entertainment product on a private basis for a limited period of time not to exceed forty-eight (48) hours from the time viewing is initiated by the consumer and not to exceed thirty (30) days from the date the consumer pays the separate transactional fee.
TVOD means the exhibition or delivery of the Package on an “on-demand” basis via the Internet, in exchange for consideration paid by the end user for the right to view solely the Package, where the start time is scheduled by the end user and not Licensee, where the end user may view the Package once or repeatedly solely during a limited viewing period (which must be initiated within thirty (30) days of purchase and which shall not exceed seventy-two
