Tunnel Work. (Compensation for Travel Within Tunnel) The individual Contractor shall pay employees covered by this Agreement working within the tunnel, adits, or shafts, on a portal to portal basis as follows: The hours of employment of such employee shall commence at the portal of the tunnel, adit or shaft at which he is directed by the individual Contractor to report for work on his shift and shall end at such portal.

Tunnel Work means all workmanship, materials and anything and everything required to be done to achieve the Milestone Acceptance in respect of the Tunnel and includes the design, construction, testing, and completion of the Tunnel to be performed by Project Co in accordance with this Project Agreement as may be varied, amended or supplemented from time to time in accordance with this Project Agreement.

Tunnel Work means all work and activities of or required of Project Co and its sub-contractors in connection with the performance of any obligations of Project Co under the Project Agreement, and the conduct of all work and operations of Project Co and the sub-contractors on or in relation to all works and component required to complete the portion of the power tunnel between the bottom of the intake or upstream drop shaft, as applicable, and the downstream tunnel portal.

• Attached hereto are Schedules “A”, and to this Agreement which outline Hours of Work, Overtime, Wage Rates and Shift Premiums in Open Cut Work, Tunnel Work, and Work in County respectively.

• A schedule applying to Tunnel Work, which is to be interpreted to mean a project called as a Tunnel and does not include Tunnel Work which is incidental to Open-Cut Work, for Sewer and Watermain Construction.

• CATEGORY VI shall cover the following rates paid over and above basic rate: Caisson and Tunnel Work in Free Air-$1.00 over base rate Caisson Bottom Man-$2.00 over base rate Caisson and Tunnel Work in Compressed Air: CATEGORY VI (a) shall include DYNAMITE MEN and will be paid one dollar and seventy-five cents ($1.75) per hour over the basic rate.

• Purchaser hereby grants to ▇▇▇-▇▇▇ ▇▇▇▇▇▇▇ ▇▇▇▇▇▇ Associates a right of entry upon the Property to the extent necessary to perform the Tunnel Work.

• At Closing, Net Lessee shall deposit with ▇▇▇-▇▇▇ ▇▇▇▇▇▇▇ ▇▇▇▇▇▇ Associates Net Lessee's share of the total cost of the Tunnel Work as reasonably estimated by ▇▇▇-▇▇▇ ▇▇▇▇▇▇▇ ▇▇▇▇▇▇ Associates and shall be responsible for any shortfall.
