Trusted Data Sharing Organization. (“TDSO”) is a legal entity that performs Health Information Exchange (“HIE”) activities and/or functions using a “System” that generally encompasses a software and hardware portal platform or other electronic medium that is controlled by a TDSO, by ownership, lease, license or otherwise, and is the mechanism through which the TDSO conducts its health information exchange-related activities. TDSO will, by executing and complying with the DURSA, become connected to the NJHIN and accepts, and shall be deemed to have accepted, all of the rights, duties and obligations of a member of the NJHIN. NJII and TDSO are referred to herein collectively as the “Parties” and individually as a “Party.”
Trusted Data Sharing Organization. Effective Date: PREAMBLE This Business Associate Agreement ("BAA") is entered into by and between New Jersey Innovation Institute, Inc. The New Jersey Department of Health (“NJDOH”) owns the NJHIN. NJII manages the NJHIN on behalf of NJDOH. The TDSO has entered into one or more Use Cases that authorize the TDSO to participate in specific uses of the NJHIN (“Use Cases”).
