Trust Preferred Subdebt definition

Trust Preferred Subdebt means (i) $450,450,000 aggregate principal amount of 77/8% Dollar-denominated senior subordinated notes due 2008 issued by FMC Trust Finance S.à r.▇. Luxembourg to Fresenius Medical Care Capital Trust II, (ii) DM300,300,000 aggregate principal amount of 73/8% Deutsche m▇▇▇-denominated senior subordinated notes due 2008 issued by FMC Trust Finance S.à r.▇. Luxembourg to Fresenius Medical Care Capital Trust III and assumed by FMCAG as of December 23, 2004, (iii) $225,225,000 aggregate principal amount of 77/8% Dollar-denominated senior subordinated notes due 2011 issued by FMC Trust Finance S.à r.▇. Luxembourg-III to Fresenius Medical Care Capital Trust IV and (iv) €300,300,000 aggregate principal amount of 73/8 % Euro-denominated senior subordinated notes due 2011 issued by FMC Trust Finance S.à r.▇. Luxembourg-III to Fresenius Medical Care Capital Trust V and assumed by FMCAG as of December 23, 2004, in each case in connection with a related issuance of Trust Preferred Securities and, to the extent permitted hereunder, and any additional Subordinated Debt incurred in connection with a related issuance of additional Trust Preferred Securities issued after the Closing Date by members of the Consolidated Group.
