Trapeze means Trapeze Capital Corp. acting as agent for the Holders pursuant to the Security Agent Agreement.

  • Trapeze shall use reasonable endeavours to transfer to the Customer the benefit of any warranty or guarantee given by the manufacturer to Trapeze.

  • In the event of any loss or damage to Customer Data, the Customer's sole and exclusive remedy shall be for Trapeze to use reasonable commercial endeavours to restore the lost or damaged Customer Data from the latest back-up of such Customer Data maintained by Trapeze in accordance with the archiving procedure described in its Back-Up Policy.
