Transportation Claim definition

Transportation Claim means any claim of or by any shipper or receiver for loss, damage or overcharge or by any Contractor (including owner-operators, fleet owners and/or independent contract drivers) for loss, damage or overcharge for any transportation transaction, as well as all other claims arising out of transportation activities (including claims for personal injury or death, or damage to property, arising out of motor vehicle or other accidents.) As used in this Agreement, the word "material" as it applies to Losses resulting from any breach of any representation, warranty, covenant or agreement shall mean any individual Loss in excess of One Thousand ($1,000) Dollars.
