Transient occupant definition

Transient occupant means any person or a guest or invitee of such person, who, in exchange for compensation, occupies or is in actual or apparent control or possession of residential property, which is either: (1) registered as a short-term rental property, or (2) satisfies the definition of a short-term rental property, as such term is defined in this section. It shall be a rebuttable presumption that any person who holds themselves out as being an occupant or guest of an occupant of the short-term rental is a transient occupant.

Transient occupant for purpose of this chapter means any person who exercises occupancy or is entitled to occupancy by reason of concession, permit, right of access, license or other agreement for a period of 25 consecutive calendar days or less, counting portions of a calendar day as full days. Transient occupant means any person who occupies an accommodation in a timeshare property and provides rental income to the developer or associated to occupy the accommodation. Transient occupant does not include any person who uses an accommodation as a promotion, timeshare interest or exchange program.

Transient occupant is a person whose residence in a dwelling has occurred for a brief period of time, is not subject to a lease and is intended to be transient in nature. § 82.045(1), Fla. Stat., sets forth a collection of factors pertinent to establishing whether a person is a transient occupant. Factors tending to indicate the person is not a transient occupant include having an ownership interest, financial interest, or leasehold interest in the property, having utility subscriptions; and, having a designated space of his or her own. Factors tending to indicate the person is a transient occupant include: not using the property address as an address of record with any governmental agency such as the Department of Highway Safety and Motor Vehicles, not paying rent (excluding minor contributions); not receiving mail at the property, and having a permanent residence elsewhere. § 82.045(1)(a) and (b).
