Total Claim definition

Total Claim means the amount that a Claiming Class Member would receive pursuant to the Plan of Allocation prior to any weighting or pro rata distribution. Plaintiffs shall seek Court approval for the formula used to calculate a Claiming Class Member’s Total Claim, which formula Plaintiffs have shared with Defendants and with respect to which Defendants have agreed to take no position. By agreeing to take no position with respect to the use of the formula for the purposes of this settlement only, Defendants do not thereby agree that the formula is generally appropriate for calculating au pair compensation.

Examples of Total Claim in a sentence

  • If, within the Claim Settlement Period, Employer Payments exceed the Claim Settlement Total, Claim Administrator may, at its option, pay such difference to Employer, apply the difference against amounts then owed Claim Administrator by Employer or authorize a reduction equal to such difference from the next Claim Settlement Total due Claim Administrator from Employer.

  • If the Total Claim Amount is less than $7,500,000.00, then the Settlement Account amount to be funded by American shall be $7,500,000.00.

  • Within twenty-one (21) Days of the Effective Date, American will cause an amount sufficient to cover the Total Claim Amount (but in no event less than $7,500,000.00) to be transferred to the Settlement Account as designated by the Settlement Administrator.

  • Any interest that accrues on the Total Claim Amount (or $7,500,000.00) in the Settlement Account will be the property of the Settlement Classes and added to the Refunds distributed to Settlement Class Members.

  • Under no circumstances shall American be obligated to pay more under this Settlement Agreement than the Total Claim Amount or $7,500,000.00, whichever is greater, excluding Notice and Administration Costs, the Attorneys’ Fee Award, and the Service Awards.

  • Licensee shall deduct royalty payments otherwise due to Licensor under this Agreement to account for Licensor’s share in the Total Claim Amount.

  • If the Total Claim Amount is equal to or greater than $7,500,000.00, then the Settlement Account amount to be funded by American shall be equal to the Total Claim Amount, and the Refund for each Valid Claimant shall be equal to the amount of their respective At-Issue Baggage Fees.

  • The difference between $7,500,000.00 and the Total Claim Amount shall be paid to Valid Claimants on a pro rata basis based on the amount of each Valid Claimant’s respective At-Issue Baggage Fees, and each Valid Claimant’s total Refund will be equal to their respective At-Issue Baggage Fees plus any pro rata allocation as described in this paragraph.

  • The Total Claim Amount expended by each of Licensor and Licensee shall be shared equally (subject to the below limitation on quarterly royalty payments) by Licensor and Licensee.

  • Expiration of this Agreement shall not relieve the Parties from liability for its violation and the Cessionary from payment of the Total Claim (Rights) Price.
